This Beko HarvestFresh “Keep it Fresh” Sweepstakes (the “Sweepstakes”) is sponsored and administered by Beko US, Inc. (“Beko”), 333 Gibraltar Dr., Bolingbrook, IL 60440. By entering into the Sweepstakes, each Entrant agrees to abide by these Official Sweepstakes Rules and Legal Disclaimer and the decisions of Beko, such decisions which are final and binding in all respects.

1.      ELIGIBILITY: This Sweepstakes is open only to legal residents of the United States (excluding Alaska, Rhode Island, and U.S. Territories and Possessions outside of the United States and where otherwise prohibited by law), who are of the age of majority (i.e., a legal adult) in their state of residence at the time of entry and who are employed as sales associates at a Beko authorized dealer (“Dealer”) during the Sweepstakes Period (“Entrant” or “you”). All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. 

2.      SWEEPSTAKES PERIOD; RULES:  No purchase is necessary to enter or win. A purchase does not improve the chances of winning the Sweepstakes.

The Sweepstakes will run from April 22, 2024 at 12:01 am CST and end on July 31, 2024 at 11:59 pm CST (“Sweepstakes Period”).  An Entrant that sells ten (10) or more eligible products will earn one (1) entry ticket that represents a single entry in the Sweepstakes.  Only products corresponding to the eligible stock keeping units (SKUs) set forth in Figure 1 below are deemed “Eligible Products”.  Entrants will also earn one (1) entry ticket for every subsequent ten (10) Eligible Products sold during the Sweepstakes Period.  For example, if an Entrant sells sixty-four (64) Eligible Products, then the Entrant will earn six (6) entry tickets in total.  On October 15, 2024, between 4:00 p.m. and 4:30 p.m. CST, the winning entry ticket will be selected by random draw. The Entrant connected to the winning entry ticket will be eligible to receive the prize, subject to the verification requirements and terms set forth in these Rules.   

The number of Eligible Products sold per sales associates will be determined through the data the Entrant submits to Beko’s 360Insights platform in connection with receiving Sales Performance Incentive Funds (SPIFFs) for the sale of Eligible Products.  Entrants must submit serial numbers of Eligible Products sold in the 360Insights platform within 60 days of sale and no later than September 30, 2024 at 11:59 pm CST.  Any Eligible Products returned by the purchasers will not count towards any Entrant’s total number of Eligible Products sold.

For Entrants working at Dealers who do not use the 360Insights platform, the Dealer that employes each Entrant must submit to Beko the sell-out data for Eligible Products for its sale associate Entrants during the Sweepstakes Period on or before September 30, 2024 at 11:59 pm CST via email at social@beko.com. It is the responsibility of the Entrant to make sure that the Dealer reports the sell-out data for Eligible Products to Beko on or before September 30, 2024 at 11:59 pm CST. The sell-out data shall include the name of the Entrant, the list of Eligible Products sold (listed by SKU), and the count of Eligible Products sold.  Failure of the Dealer to timely provide the sell-out data disqualifies the Entrant from the Sweepstakes.

Beko will not consider incorrect, fraudulent, incomplete, late, or otherwise non-conforming sell-out data. Any Entrant using fraudulent or deceptive means to participate in the Sweepstakes will be disqualified and may be guilty of violating applicable criminal laws. Eligibility is at the exclusive discretion of Beko, and Beko shall be entitled to reject any Entrant for any reason or no reason at all without having to provide an explanation. Beko reserves the right, in its sole discretion, to cancel, suspend, or terminate the Sweepstakes for any reason and without prior notice to any Entrant. In such instance, Beko may, if and as appropriate, select a winner using reasonable means that are materially consistent with the Sweepstakes.

By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to be bound by and accepts these official rules (the “Official Rules”) which are final and binding in all respects.  Any violation of these Official Rules may, at Beko’s sole discretion, result in disqualification.

Beko will be collecting, storing, and using personal data about Entrants to administer the Sweepstakes and exercise its rights hereunder, including without limitation, those relating to marketing and publicity. By entering into the Sweepstakes, Entrants agree to Beko’s collection and use of their personal information. All Entrant information, including e-mail addresses, is subject to the privacy policy and terms of service of Beko. 1.      ENTRANT’S REPRESENTATIONS AND WARRANTIES: By entering into the Sweepstakes, Entrant represents and warrants as follows: (1) that the Entrant is at least eighteen (18) years of age or the age of majority in the jurisdiction in which the Entrant resides, and the Entrant is otherwise able to form a binding contract with Beko; (2) that Entrant is employed as a sales associate at a Beko authorized dealer; and (3) that any and all materials or information provided by Entrant hereunder shall be true and correct in all respects.

2.      PRIZE: One (1) prize will be awarded. The Entrant who is selected in the random draw will be eligible to receive the prize (“Winner”).  The prize (“Prize”) shall consist of the following:

                                            i.            Stay for four (4) days/three (3) nights for two adults at UNICO 20 87 Riviera Maya All Inclusive Hotel in Cancun, Mexico;

                                          ii.            Roundtrip economy class airfare for two adults from the major airport nearest to Winner’s place of residence to Cancun International Airport; and

                                        iii.            Round trip car service from Winner’s place of residence to nearest major airport and from Cancun International Airport to resort.

Estimated retail value of the prize: The maximum estimated value of the trip will all taxes and fees cannot exceed US$4,999 in total. Actual value of the trip will depend on point of departure and any airfare fluctuations. Any difference between stated value and actual value will not be awarded.

Limitations:

                                            I.            All other costs and expenses related to Prize acceptance and use not specified herein as being provided are the sole responsibility of the Winner, including any upgrades to the flight or car service.

                                         II.            Winner is solely responsible for any taxes on their Prize.

                                      III.            The travel must occur during the months of January 2025, February 2025, June 2025, July 2025 or August 2025. Beko (and its travel agency) cannot guarantee availability of flights or reservations and the Winner is not guaranteed their desired dates and times of travel.  If the Winner is not available on the specified dates, Winner will be disqualified and Beko reserves the right to choose an alternative prize Winner.

                                      IV.            All travelers are required to have a valid passport and any other documents necessary for international travel at the time of travel. Legal names and dates of birth will need to be provided to Beko by the Winner and their travel companion to complete travel arrangements.

                                        V.            No traveler companions under the age of 21 will be booked unless accompanied by an adult age 25 years or older, except for married couples under the age of 21.

                                      VI.            Prize is not transferable, cannot be resold, and is not redeemable for cash or any other form of value-added compensation.

                                   VII.            Unclaimed Prize will not be awarded.

                                VIII.            If a Prize, or any portion thereof, cannot be awarded for any reason, Beko reserves the right to substitute such Prize with another Prize of equal or greater value, as determined by Beko in its sole discretion.

NOTIFYING PRIZE WINNERS: Beko will notify the potential Winner on October 16, 2024 via the email address on file with the Dealer (the "Notification"), and shall provide the Winner with a form of an Affidavit of Eligibility and Release (“Affidavit”).  The potential Winner must sign and return the Affidavit and provide their SSN by October 30, 2024.  Failure to respond within the applicable time period will result in forfeiture of the Prize, and Beko shall have the option to award the Prize to an alternate Winner. The return of the Notification or Prize as undeliverable may also result in disqualification and an alternate Winner may be selected. Beko is not responsible for digital communications that are undeliverable as a result of any filtering of any kind, insufficient space in an Entrant’s email inbox, or any other failure beyond its reasonable control. A potential Winner will also forfeit his or her Prize if he or she is disqualified as not eligible to have participated in the Sweepstakes in the first instance.

Within one (1) week of the receipt of the Affidavit and confirmation of Winner’s eligibility, Beko shall contact Winner via email to finalize the process of delivery of the Prize.

All federal, state, and local income taxes resulting from acceptance of the Prize are the responsibility of Winner.  Because the Prize is valued at $600 or more, the Winner will be provided with a 1099 form by Beko. Beko reserves the right to substitute an alternate Prize of comparable or equal value in its sole discretion. Acceptance of the Prize also constitutes permission to Beko to use the Winner's name, likeness, and biographical information for marketing purposes (including posting the information on their websites) without further compensation or right of approval, unless prohibited by law.

SUBJECT TO APPLICABLE LAW, THE PRIZE IS OFFERED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND OR NATURE, INCLUDING WITHOUT LIMITATION, ANY WARRANTY RESPECTING CONDITION, MERCHANTABILITY, QUALITY, TITLE, OR FITNESS FOR A PARTICULAR PURPOSE.

3.      PUBLICITY: Subject to applicable law, participation in the Sweepstakes constitutes Entrant's consent to Beko and its affiliates and agents to use his or her name, voice, likeness, opinions, and biographical information for marketing, advertising, and publicity purposes in any media throughout the world at any time without the obligation to seek consent or to provide Entrant with any payment or other form of consideration. Entrant agrees to execute any document reasonably required by Beko to effectuate the terms hereof and failure to do so shall give rise to Beko’s right to execute any and all such documents as Entrant's attorney-in-fact, which right shall be coupled with an interest and therefore, irrevocable.

4.      LIMITATION OF LIABILITY, RELEASES AND INDEMNITY:  By participating in this Sweepstakes, each Entrant agrees that Beko and any other party associated with the development or administration of this Sweepstakes; its parent, subsidiary, and affiliated entities; and the respective officers, directors, members, shareholders, employees, independent contractors, agents, attorneys, representatives, successors and assigns of each (collectively, “Released Parties”) are not responsible for: (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable e-mail/text notifications or postal mail; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes; (vi) any injury or damage, whether personal or property, to Entrant related to or resulting from participating in the Sweepstakes, accepting the Prize, and/or use of the Prize; and (vii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules.

By entering the Sweepstakes, each Entrant agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of the Entrant’s rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstakes and use of the Prize; and (iv) to forever and irrevocably agree to release, discharge and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Sweepstakes-related activity or element thereof, and the Entrant’s entries, participation or inability to participate in the Sweepstakes; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, use, non-use, misuse, inability to use, loss, negligence or willful misconduct in connection with the use of the Prize; (d) any change in the Prize (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed Prize (or any element thereof); (h) tax issues; or (i) the negligence or willful misconduct by any Entrant.

By entering this Sweepstakes, each Entrant hereby agrees to indemnify and hold the Released Parties harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all claims, damages, injuries, death, liabilities, losses, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of the Entrant hereunder, or any actions taken in connection with the receipt, use, or misuse of any Prize, no matter how such claim or loss arises, or relating to or arising directly or indirectly out of the Entrant’s participation in the Sweepstakes (or related activity such as a press release), and/or Beko’s right to exploit Entrant’s name and/or likeness or fully exploit any other right granted to it hereunder.

WITHOUT LIMITING THE FOREGOING, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 

UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS SWEEPSTAKES. BEKO’S FAILURE TO ENFORCE ANY PROVISION IN THESE OFFICIAL RULES WILL NOT BE DEEMED A WAIVER OF SUCH.

5.      APPLICABLE LAWS, JURISDICTION AND DISPUTES: ALL CLAIMS AND CONTROVERSIES SHALL BE RESOLVED THROUGH MANDATORY BINDING ARBITRATION UNLESS OTHERWISE REQUIRED BY LAW. THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ILLINOIS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN DUPAGE COUNTY, ILLINOIS, OR THE NORTHERN DISTRICT OF ILLINOIS’S FEDERAL COURT. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“AAA RULES”). THE AAA RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN ILLINOIS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN DUPAGE COUNTY, ILLINOIS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES NOT TO EXCEED THE ACTUAL CASH VALUE OF THE PRIZE, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR THE RELEASED PARTIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE SWEEPSTAKES PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

6.      DISCLOSURE OF NAME AND ADDRESS OF THE WINNER: The name and address of the Winner may be obtained by sending a self-addressed stamped envelope to Beko US, Inc., 333 Gibraltar Dr., Bolingbrook, IL 60440, Attn: Keep It Fresh Sweepstakes. Beko shall provide the name and address of the winner to any person upon request within 60 days of Beko’s receipt of the request.  Request for the name and address of the Winner must be received no later than 180 days after Sweepstakes ends.  By participating in the Sweepstakes, you agree to having your name and address provided to anyone who may properly request the name of the Winner under this paragraph.
